Terms and Conditions for Shipping Through Philadelphia Cargo Shipping Agency.

These Terms and Conditions govern the shipping services provided by Philadelphia Cargo Shipping Agency ("Company") for shipments from the United Kingdom to Tripoli, Libya. By using our services, you agree to comply with these Terms.

1. Prohibited Goods

The following items are strictly prohibited from being shipped through our services:

• Illegal substances and narcotics
• Firearms, ammunition, and explosives.
• Hazardous chemicals and materials.
• Perishable goods without proper packaging and documentation.
• Items restricted or prohibited by UK or Libyan laws and regulations.
• Counterfeit or pirated goods.
• Live animals.
• Human remains.
• Precious metals and stones without proper documentation.
• Cultural artifacts and antiques without proper permits.

2. Dangerous Goods

Shipping of dangerous goods is subject to strict regulations and requires prior approval from the Company. Dangerous goods include, but are not limited to:

• Flammable liquids and solids.
• Corrosive substances.
• Radioactive materials.
• Toxic and infectious substances.
• Compressed gases.
• Oxidizers and organic peroxides.

Customers must provide complete and accurate documentation for all dangerous goods, including Material Safety Data Sheets (MSDS), and comply with all applicable regulations. Failure to declare dangerous goods can result in penalties and shipment delays.

3. Liability and Limitation of Liability

The Company will take reasonable precautions to ensure the safe and timely delivery of goods. However, the Company is not liable for any loss, damage, or delay caused by:

• Acts of God (natural disasters, severe weather, etc.).
• War, terrorism, or civil disturbances.
• Acts of public authoritieswaterm.
• Strikes, labour disputes, or lockouts.
• Inherent vice or defect of the goods.
• Insufficient or improper packaging.
• Failure of the consignee to accept delivery.
• Damage caused during container inspection process by customs office.

In the event of loss or damage to the goods, the Company’s liability is limited to the lesser of the declared value of the goods or the actual loss sustained, subject to a maximum liability of £100 per shipment, unless additional insurance coverage has been purchased.

4. No Consumption or Use of Goods

The Company strictly prohibits the consumption or use of shipped goods by any party during transit. Goods must remain sealed and intact until they reach the destination and are delivered to the consignee. Any unauthorized use or consumption of goods will result in immediate termination of the shipping contract and potential legal action.

5. Claims and Compensation

In case of loss or damage to goods, the customer must notify the Company in writing within seven (7) days of delivery. All claims must be accompanied by:

• Original shipping documents.
• Proof of value of the goods.
• Detailed description of the loss or damage.

The Company will investigate the claim and, if deemed valid, provide compensation in accordance with the liability limitations stated in Section 4. No compensation will be provided for goods prohibited by these Terms or for any consequential or indirect losses.

6. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the United Kingdom. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.

7. Amendments

The Company reserves the right to amend these Terms at any time without prior notice. Customers are advised to review the Terms regularly to stay informed of any changes.

8. Acceptance of Terms

By using the Company’s shipping services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
